Here are a few of the key takeaways:

  • In Washington State - Starting Oct 1, 2025, additional retail (sales) tax applies to specific digital services including advertising, custom software, web development, IT services, and live presentations.
  • Professional services such as lawyers, accountants, engineers, architects, and lobbyists are exempt from the retail sales tax (still have to submit your B&O Taxes as a SERVICES business though)
  • Existing contracts have a grace period until March 31, 2026 if the scope remains unchanged
  • Sales tax rates vary by destination zip code; businesses must update their systems to collect taxes properly
  • The Department of Revenue (DOR) is still issuing interim guidance, so businesses should monitor the Washington DOR Website frequently for updates.

Lots of questions around Live Presentations, so here's some highlights:

Live Presentations Details

  • Must be live/real-time with presenter and audience
  • Purpose is to inform, educate, or persuade on a subject
  • Allows for interaction, though not required
  • Must have more than one attendee
  • Excludes movies, sporting events, fundraising activities
  • One-on-one interactions like tutoring, consulting, or music lessons are exempt
  • Professional services where the presentation is part of delivering a broader service are exempt
  • Attendees who are NOT located in Washington State but are attending remote live presentations do not have to be charged WA State sales tax (unless your business has reached Economic Nexus (a revenue threshold) in that state for the year.
  • WA State Sales tax rate is based on
    • city where the presentation is being delivered (if delivered in person)
    • where the attendee is located for billing purposes (if delivered remote over video conferencing)
